BEFORE: KRUPANSKY, NELSON and RYAN, Circuit Judges This case has been referred to a panel of the Court pursuant to Rule 9 (a), Rules of the Sixth Circuit. Upon examination of the briefs and record, this panel agrees unanimously that oral argument is not needed. Rule 34 (a), Federal Rules of Appellate Procedure. In this action under 42 U.S.C. § 1983, plaintiff alleges that the defendants violated his eighth amendment right to be free from cruel and unusual punishment. Plaintiff claims this occurred in the course of his being treated for an ankle injury sustained in a prison football game. The district court granted summary judgment for defendants and this appeal followed. On appeal the parties have briefed the issues, plaintiff proceeding pro se.
